Image Red Studio Terms and Conditions

​

Image Red Studio Booking terms and conditions are as follows:

​

Terms are automatically agreed once a booking has been made

​

1. Booking confirmation

1a. A booking is considered confirmed after Image Red Studio receives a cleared balance payment.

​

2. Booking Times

2a. Booking times start as per confirmed time, if the client is late the booking will still end at the original finishing time otherwise charges will occur.

​

3. Set up and take down time

3a. The client must include set up and take down/clean up time with the hours booked to avoid overtime charges

​

4. Leaving the studio in a reasonable state

4a. Studio space must be left in a reasonable state and left as found at the beginning of the clients booking. Image Red Studio reserves the right to charge an appropriate fee (starting from £20) for any cleaning/damage repair we are required to conduct after your booking in order to restore the studio to its original state.

5. Handling of studio sets

5a. Clients must not move any fixtures, fittings or furniture without the express permission of studio staff and only studio staff are authorised to  move fixtures, fittings or furniture within a set.

6. Use of studio and client equipment

6a. Studio hire comes with a range of lighting and studio equipment as standard. With extras to be hired out at the request of the booker. All equipment used must be returned promptly at the end of the hire period in the original condition and the client is liable for repair or replacement costs that occur from damaged or missing equipment.

6b. The client may not without the written consent of Image Red Studio; remove equipment from the studio premises; modify or alter or tamper with equipment in anyway; or use the equipment in a manner not recommended by the manufacturer. None of the equipment is to be used by any untrained or unauthorised personnel.

6c. All kit and backdrops are subject to availability.

6d. Studio staff are not responsible for the handling, setting up, use or, adjustment of, or taking down of a clients equipment.

7. Inclusivity

7a. Image Red aims to promote a culture of inclusion where everyone feels valued and has equal access to opportunities and resources. In line with Government guidelines on inclusivity policies within the workplace, we aim to ensure equality, fairness, and respect for all individuals and do not support attitudes and actions that express contempt or prejudice against anyone irrespective of their gender, sexuality, ethnicity or religious belief.

7b. Image Red Studio will not accept bookings from any individual or group that intends on using the studio to exclusively promote a particular political belief, religious, cultural or moral ideology which may be seen to cause offence, contempt or prejudice against any other third party.

8. Minors

8a. Studio hire clients must ensure that all minors under the age of 18 are always accompanied by their legal parents or guardians who must remain in the studio with the minors at all times whilst the minors are being filmed/photographed.

8b. Further more to condition 5a, Image Red Studio will not post any image or video of a minor and will not accept any social media collaboration or tagging from any third party that it believes to depict a minor.

 

9. Model Safely Policy

The Image Red Studio Model Safety Policy is as follows:

  1. We do not allow under any circumstances admittance to changing rooms apart from models and stylists and chaperones. 

  2. The changing room is accessed both from the main corridor and directly from the ground floor studio. For model privacy, both changing room doors have internal locks. For studio safety, studio staff have the ability to open these doors in the case of an emergency.  We encourage models to enter the ground floor studio via the changing room studio door, not via main reception.

  3. We will allow and honour any requests for closed sets but will ask for a verbal confirmation from the model on the day before commencement of the shoot. In a closed set, the door between the reception/viewing area and the ground floor studio will be pushed to, but for the safety of all persons within the studio and the studio itself, we do not allow any studio door to be fully closed or secured in any way that may prevent easy exit from the studio.

  4. Photographers are not under any circumstances permitted to ask for or make any physical contact with models including moving hair or adjusting clothing.

  5. Any photographers either found by studio staff or reported by a model, to be behaving or communicating with a model in a suggestive, sexual or inappropriate way will be asked to leave the studio.

  6. Image Red operates a zero-tolerance policy to attitudes and actions that express contempt or prejudice against anyone irrespective of their gender, ethnicity or religious belief.

  7. Image Red Studio reserves the right to cancel with immediate effect any existing or future booking from any person or persons it deems to have contravened the Image Red Studio Model Safety Policy.

If any of these conditions have been violated, or a model makes it clear to a member of the studio staff that he/she does not feel comfortable with the shoot, Image Red Studio reserves the right to terminate the shoot with immediate effect.

10. Chaperones

  1. Chaperones are allowed into changing rooms as long as the only other person/persons in the changing room are the person/persons they are chaperoning. 

  2. Chaperones are allowed in the viewing area where they can watch the shoot but are asked not to stand in the studio area or interfere with the shoot itself unless they believe there is a safety issue.

 

11. Public liability

11a. Image Red Studio public liability insurance is with AXA Business Policy Number: 550287049

11b. Although food/drink (non alcoholic) is permitted to be consumed within the studio hire booking, the client who booked the studio is responsible for all allergies and complications that can arise from perishable/consumable items.

12. Breakages, losses and damages

12a. The studio hire client is responsible for any breakages, losses or damages caused to the studio or equipment by the client, or any other person(s), during the allotted booking time.

12b. All the equipment used is at the risk of the client and Image Red Studio shall not be liable for any loss or damage to materials, props or equipment. This includes consequential loss of profit however caused, arising out of the use of, or the inability to use the equipment supplied or agreed to be supplied (all equipment is subject to availability).

12c. No alterations or additions to the studio space or equipment is permitted without prior written consent.

12d. The client must notify staff at the time of supply if the condition of the equipment is not acceptable, and shall pay any costs incurred by Image Red Studio arising out of any breach of the prior conditions.

12e. Image Red Studio shall not be liable to the client for any loss, damage, expense or for any consequential loss (including loss of profit) arising out of or in connection with; Any damage to loss of property by the client or any third party. Any breakdown, stoppage or failure of the facilities/equipment provided by Image Red Studio.

13. Copyright

13a. In the UK, the law on copyright provides that the author of the work (the photographer) is the owner of a picture they have taken. However if the photographer has been commissioned to provide the pictures then once payment has been made the copyright passes to the purchaser. In the case of time for print / content share agreements the copyright is shared between both parties.

13b. Image Red Studio does not own copyright of any images taken at our studio. However if pictures are taken at Image Red Studio by resident photographers Simon Bond, Jon Foster or Becky then copyright is determined according to condition 9a above.

13c. Image Red Studio may request usage of images taken by clients for use as examples of shoots taking place in the studio including behind the scenes images. In these cases the studio will always seek permission from the copyright holder as determined in 9a. above, before doing so.

14. Image requests

14a. Where a model is being paid for a shoot the model does not have an automatic  right to gain images from a photograher although in most cases a photographer will be happy to do so if so requested.

14b.  Where a model is working on a TFP,  content share, or is paying for the shoot, the model has the right to ask the photographer for images. The number of images and timescale sharing of those images is to be agreed before the event.

15. Payment terms, deposits, charges and cancellations for model studio days

15a. For Studio Days booked by the model, it is the responsibility of the model alongside Image Red Studio to promote the studio day. Image Red studio will ask the model for a £50 deposit to secure the date requested. The balance is payable to the studio at the end of their studio day. If photographers either cancel or fail to arrive for their prebooked shoot with the model, the studio fees for the cancelled hours are waivered. If all photographers cancel or none fail to arrive then the deposit of £50 is retained by the studio.

15b. For Model Studio Days booked by Image Red Studio, Image Red studio will promote the studio day on its website, socials and contact database but can in no way guarantee that any of all of the slots will be confirmed/booked. The model agress to pay Image Red the agreed hourly rate times the number of photographers booked on the studio day and this is payable to the studio at the end of their studio day. If photographers either cancel or fail to arrive for their prebooked shoot with the model, the studio fees for the cancelled hours are waivered and the studio has no liability to the model for loss of income as a result of cancellations or no-shows.

15c. In regards to PurplePort bookings between Image Red Studio and the model for both items 10a and 10b above, a PurplePort booking ensures that the booked time slot will remain available for the model but in no way guarantees the income due from a photographer for that slot as per conditions 10a and 10b above.

15d. In regards to items 10a and 10b above, Image Red Studio will take a £25 non-refundable deposit from each photographer to secure their booking and on completion of the model day this £25 is deducted from the money owed by the photographer. If a photographer cancels their slot within 48 hours of the start of the time slot, the photographer is liable for a cancellation fee equivalent to 50% of the total booking fee, taking into account the £25 deposit paid. If a photographer cancels within 24 hours of the start of the time slot, the photographer is liable for a cancellation fee equivalent to 100% of the total booking fee, taking into account the £25 deposit paid.

16. Payment terms, deposits, charges and cancellations for general studio hire

The following terms apply to photographers, models, commercial hirers or any other party wishing to book studio stime whether online or directly through the studio.  

16a. All bookings must be for a minimum of two hours studio hire.

16b. Image Red studio will ask the hirer for a 25% deposit of the total studio hire fee with the balance payable to the studio on completion of the studio hire.

16c. In the event of cancellation by the studio, a full refund of the deposit will be refunded to the hirer. In the event of cancellation by the hirer within 24 hours of the start of the hire period, the hirer is liable to a cancellation fee of 25% of the total studio fee and thus loses the deposit paid to the studio.

17. Payment terms, deposits, charges and cancellations for workshops organised by Image Red Studio

17a. In the case of evening workshops organised by Image Red Studio, photographers will be asked for a £25 deposit to secure their place on the workshop with the balance of the workshop fee being paid on arrival at the studio. If the photographer cancels their place on the workshop within 24 hours of the start time of the workshop, the deposit will be retained as a £25 cancellation fee.

17b. It is the responsibility of Image Red Studio to notify the model of the number of confirmed attendees within 72 hours of the start time of the workshop in order to make a decision as to whether the workshop is financially viable to go ahead. If a joint decision is made to cancel the workshop, Image Red studio is not liable to the model for any financial loss and also Image Red studio agrees to refund deposits paid by photographers.

17c. If a model cancels a workshop within 24 hours of the start time of the workshop, the model is liable to Image Red Studio for the deposits paid to Image Red Studio by photographers and is thus liable for a cancellation charge of £25 per photographer.

17d. On completion of the workshop, Image Red agrees to pay the model half of the total income gained from that workshop. For example if the workshop is advertised at £60 per photographer and 4 photographers are in attendance, the total of £240 will be split 50% to the model and 50% to Image Red Studio.

18. Termination

18a. Image Red Studio may terminate any booking or hire contract if the client is found to be in breach of any terms and conditions.

18b. If a client is found to be aggressive, malicious or disrespectful to a member of Image Red studio staff, the staff member reserves the right to terminate any booking immediately and ban the client from any future bookings.

18c. If a previously banned client uses another person to book Image Red Studio and is found to be within the building the current booking will be terminated along with the current client being banned from future bookings.

18d. If a client is in breach of the Image Red Studio Model Safety Policy which is clearly shown at the entrance to the studio, on our website and in these conditions.

18e. Image Red Studio may terminate any booking or hire contract if the client is found to be in breach of any terms and conditions.

19. Noise

19a. Noise levels must be kept to a reasonable level during studio hire bookings. Clients are asked to consider other occupants and neighbouring residents when using the studio.

20. Non-solicitation

20a. Clients will not directly, indirectly, or on the behalf of others; - Solicit - Induce - Recruit - Encourage or otherwise attempt to cause any employee, previous employee or consultant of Image Red Studio to perform any business/services to the client, or to terminate their relationship with Image Red Studio.

21. Variations

21a. These terms and conditions are valid at time of booking and are subject to variation. Clients will be notified of any variations prior too booking.

22. Applicable Law

22a. All agreements shall be governed by the laws of the United Kingdom
